By accessing the website, submitting a form, registering for an event, booking a session, purchasing a product or service, or otherwise using a Winners Circle offering, you agree to these Terms and any additional written terms presented for the specific transaction.
Acceptance of these Terms
These Terms form an agreement between you and The Winners Circle with Jay, referred to as “The Winners Circle,” “we,” “us,” or “our.” If you do not agree to these Terms, do not use the website or complete a registration, booking, purchase, or application.
Additional terms may apply to a particular event, program, service, invoice, order form, proposal, agreement, or checkout page. When additional written terms conflict with these general Terms, the more specific written terms control for that transaction.
Eligibility and authority
You must have the legal capacity to enter into a binding agreement. When using the website or purchasing on behalf of a company or organization, you represent that you are authorized to bind that company or organization.
Certain services, events, or content may include additional eligibility requirements, application review, approval, or participation standards.
Website, content, and services
The Winners Circle may provide business education, webinars, conferences, coaching, consulting, strategy sessions, programs, books, digital resources, podcast and magazine opportunities, media services, event access, and related content.
Descriptions, schedules, features, speakers, delivery methods, availability, and included materials may change when reasonably necessary. We may correct errors, update content, or discontinue an offering, subject to any binding written agreement or applicable law.
Registration, bookings, and account information
You agree to provide accurate, complete, and current information when submitting a form, registering for an event, booking a session, applying for a program, or making a purchase.
- Use an email address and telephone number you control.
- Review event, ticket, service, and date selections before submitting.
- Keep confirmation messages, private access links, passwords, and booking details secure.
- Notify us promptly if you believe access information has been compromised.
Registrations, applications, or bookings may be declined, cancelled, or limited where information is inaccurate, payment is incomplete, capacity has been reached, or use would violate these Terms.
Prices, payments, cancellations, and refunds
Prices are shown in the currency stated on the applicable page, invoice, checkout, proposal, or agreement. You authorize the applicable payment provider to charge the payment method you submit for the selected product or service.
Refunds, transfers, cancellations, credits, installment terms, late-payment consequences, and rescheduling rights are governed by the policy displayed at purchase or the written agreement for that offering. Where no separate policy is presented, contact us promptly through the Contact page so the request can be reviewed.
Nothing in these Terms limits non-waivable consumer rights or remedies required by applicable law. Chargebacks or payment disputes submitted in bad faith may result in suspension of access while the matter is investigated.
Webinars, events, live rooms, and replays
Event access is subject to registration, payment where required, capacity, technical availability, and any attendee rules communicated for the event.
- Private live-room and replay links are for the registered attendee only unless written permission says otherwise.
- You may not publish, resell, redistribute, record, rebroadcast, or share attendee-only content without permission.
- Event times may be displayed in Eastern Time; you are responsible for converting the time for your location.
- Replay access may be limited by ticket type, availability period, or event-specific terms.
- Speakers, schedules, topics, and delivery platforms may change when reasonably necessary.
We are not responsible for missed attendance caused by incorrect contact information, time-zone conversion, spam filtering, device limitations, internet interruption, or failure to complete required registration or payment steps.
Intellectual property
The website, brand names, logos, page designs, written content, videos, audio, webinar materials, frameworks, books, downloads, training materials, graphics, photographs, and related content are owned by or licensed to The Winners Circle and are protected by intellectual-property laws.
Unless written permission is provided, you receive a limited, personal, non-exclusive, non-transferable, revocable right to access purchased or registered content for your own lawful use. You may not copy, reproduce, modify, distribute, sell, sublicense, publish, upload, teach from, create derivative products from, or commercially exploit the content.
Acceptable use
You agree not to:
- Use the website or services for fraud, harassment, unlawful conduct, or infringement.
- Attempt to bypass access controls, payment requirements, or technical restrictions.
- Introduce malicious code, scrape protected content, disrupt systems, or interfere with another user.
- Impersonate another person, submit false information, or misrepresent authorization.
- Share private event, booking, replay, member, or resource links publicly.
- Use automated systems to access, copy, or extract content without written permission.
User submissions and permissions
You retain ownership of content you submit, such as messages, applications, questions, comments, business information, photographs, biographies, or media files.
You grant us permission to use submissions as reasonably necessary to review your request, provide the service, operate the event or publication, communicate with you, maintain records, and comply with law. Broader promotional use of your name, image, story, or testimonial should be governed by a separate consent, release, application term, or written agreement.
You represent that you have the necessary rights and permissions for content you submit and that it does not violate another person’s rights or applicable law.
Reviews, testimonials, and media participation
Testimonials and case studies reflect the experiences of the individuals or organizations identified and do not guarantee that another person will receive the same result.
Podcast, magazine, speaking, guest, or media participation may be subject to editorial review, recording consent, production requirements, brand standards, publication schedules, and separate written terms.
Educational and informational disclaimer
Website content, webinars, books, podcasts, magazine articles, scorecards, free resources, and general training are provided for educational and informational purposes.
They are not legal, tax, accounting, investment, medical, mental-health, or other regulated professional advice. You should consult qualified professionals regarding decisions that require advice specific to your circumstances.
No guaranteed business or financial results
Business outcomes depend on factors including market conditions, decisions, execution, experience, resources, timing, effort, and circumstances outside our control.
We do not guarantee revenue, profit, clients, contracts, financing, media coverage, audience growth, business success, or any other specific result. Examples, testimonials, and case studies are illustrative and are not promises of future performance.
Third-party websites and services
We may use or link to third-party hosting, CRM, scheduling, payment, video, podcast, event, social-media, advertising, bookselling, analytics, or communication services.
Those services are operated independently and may have separate terms, privacy practices, availability, and technical requirements. We are not responsible for independently operated third-party systems except as required by law or an applicable written agreement.
Availability, interruptions, and modifications
We do not guarantee uninterrupted or error-free access. Maintenance, outages, internet issues, provider failures, security incidents, force-majeure events, or other circumstances may affect availability.
We may update, suspend, restrict, or discontinue website features or content when reasonably necessary. Where a paid service is materially affected, any remedy will be determined by the specific agreement, posted policy, or applicable law.
Disclaimer of warranties
To the maximum extent permitted by law, the website and general content are provided “as is” and “as available.” We disclaim warranties that are not expressly stated in a written agreement, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted availability.
Some jurisdictions do not allow certain warranty exclusions, so part of this section may not apply to you.
Limitation of liability
To the maximum extent permitted by law, The Winners Circle and its owners, team members, contractors, speakers, partners, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, business opportunity, goodwill, or anticipated savings arising from use of the website or services.
Where liability cannot be excluded, total liability will be limited to the amount you paid directly for the specific offering giving rise to the claim during the period permitted by law, unless a separate written agreement or applicable law requires a different remedy.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless The Winners Circle and its owners, team members, contractors, and partners from claims, losses, liabilities, damages, and reasonable expenses arising from your unlawful conduct, violation of these Terms, misuse of content, infringement of another person’s rights, or content you submit.
Suspension and termination
We may suspend or terminate access when reasonably necessary to address nonpayment, fraud, abusive conduct, security risk, intellectual-property infringement, unauthorized sharing, or another material violation of these Terms.
Provisions that by their nature should survive termination remain effective, including payment obligations, intellectual property, disclaimers, limitations of liability, indemnification, and dispute-related provisions.
Governing principles and general terms
These Terms will be interpreted under the laws and forum identified in any applicable written agreement. Where no separate agreement specifies governing law or forum, the parties should apply the rules required by applicable law and seek to resolve disputes in good faith before pursuing formal proceedings.
If a provision is found unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without written permission.
These Terms, together with the Privacy Policy and any specific written agreement or purchase terms, constitute the applicable agreement for your use of the service.
